These Terms of Service ("Terms") govern your use of Shotpot, the photo gallery platform available at shotpot.co.uk (the "Service"), operated by Crunchy Software Ltd, a company registered in England and Wales (company number 14576468) with its registered office at 70 Grange Road East, Birkenhead, Wirral, United Kingdom, CH41 5FE ("Shotpot", "we", "us").
By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Shotpot lets photographers and event organisers upload photos, organise them into galleries, and publish those galleries so that clients and guests can view, search, and access them.
2. Accounts
- You must be at least 18 years old to create an account.
- You are responsible for the accuracy of your account details and for anything that happens under your account. Keep your sign-in access (your email inbox) secure.
- One person or organisation per account unless we agree otherwise.
3. Your content
- You own your photos. Uploading content to Shotpot does not transfer ownership to us.
- You grant us a limited, worldwide, non-exclusive licence to host, store, process (including generating resized versions), and display your content solely to operate and provide the Service — for example, serving your published galleries to visitors. This licence ends when you delete the content or your account, subject to short backup-retention windows.
- You are responsible for your content. You confirm that you have the rights and any permissions needed to upload and publish it — including, where applicable, appropriate permission from people who appear in your photos.
4. Acceptable use
You must not:
- upload content that is unlawful, infringes anyone's rights, or that you don't have permission to publish;
- upload content that is sexually explicit involving minors, or that harasses, threatens, or defames others;
- use the Service to send spam or distribute malware;
- attempt to breach, probe, or circumvent our security or access controls, or scrape the Service at scale;
- resell or white-label the Service without our written agreement.
We may remove content or suspend accounts that breach these Terms. Where practical we will notify you and give you a chance to remedy the issue first.
5. Published galleries and visitors
- Publishing a gallery makes it accessible to anyone with the link (subject to any access controls you configure). You control publishing and can unpublish at any time.
- Gallery visitors may use the Service only to view and interact with galleries as intended. Our Privacy Policy explains how visitor data is handled.
6. Plans, billing, and renewal
- Parts of the Service require a paid subscription. Current plans and prices are shown in the app at the point of purchase.
- Payments are processed by Stripe. By subscribing you authorise us (via Stripe) to charge your payment method the subscription fee at the start of each billing period.
- Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time — see our Refund & Cancellation Policy, which forms part of these Terms.
- Prices may change; we will give you at least 30 days' notice by email before a price change takes effect on your subscription, and you may cancel before it applies.
- If a payment fails we may retry it and, if it continues to fail, downgrade or suspend paid features after notice.
7. Refunds and cancellation
Our refund and cancellation terms — including a 14-day money-back guarantee on your first purchase — are set out in the Refund & Cancellation Policy. Nothing in these Terms affects your statutory rights as a consumer.
8. Service availability and changes
- We aim to keep the Service available and performant but do not guarantee uninterrupted availability.
- We may change or improve features over time. If we discontinue a material feature you pay for, we will give you reasonable notice and, where appropriate, a pro-rata refund for the unused portion of your subscription.
9. Termination
- By you: you may stop using the Service and delete your account at any time.
- By us: we may suspend or terminate your account for material breach of these Terms (with notice and an opportunity to remedy where the breach is remediable), or if required by law.
- On termination, your published galleries stop being served. You should download anything you need before deleting your account; we delete account content within 30 days of account deletion.
10. Intellectual property
The Service itself — including its software, design, and branding — is owned by Crunchy Software Ltd or its licensors. These Terms do not grant you any rights to it beyond normal use of the Service.
11. Liability
- Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be excluded under the law of England and Wales.
- We are not liable for indirect or consequential losses, loss of profits, or loss of data caused by events reasonably outside our control.
- Photos are hosted as a convenience for sharing and delivery — the Service is not a backup service, and you should keep your own originals.
- Our total liability to you in connection with the Service is limited to the amount you paid us in the 12 months before the claim arose.
- If you use the Service as a consumer, nothing in this section affects your statutory rights.
12. Changes to these Terms
We may update these Terms from time to time. For material changes we will notify account holders by email at least 14 days before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction — except that if you are a consumer living elsewhere in the UK, you may also rely on the mandatory consumer protections and courts of your home nation.
